
HOUSE CONCURRENT RESOLUTION 76
(By Mr. Speaker, Mr. Kiss, and Delegate Facemyer)
Requesting the Joint Committee on Government and Finance to conduct
a study of personal care homes in West Virginia.

Whereas, The State of West Virginia leads the nation in the
population of elderly citizens; and

Whereas, Many of our state's elderly citizens will be needing
affordable personal care; and

Whereas, Because of the strict rules and regulations being
enforced by the West Virginia Office of Health Facility Licensure
and Certification, many of West Virginia's personal care homes are
being forced out of business; and

Whereas, Many of West Virginia's elder population and their
families prefer these smaller community-based care homes to
institutional type care facilities; and

Whereas, The vast majority of individuals in personal care
homes would like to have the opportunity to choose the type of care
they need; therefore, be it

Resolved by the Legislature of West Virginia:

That the Joint Committee on Government and Finance is hereby
requested to review, examine and study the personal care home
industry and the effects of the rules and regulations that govern them; and, be it

Further Resolved, That the expenses necessary to conduct this
study and to prepare the report be paid from the legislative
appropriations to the Joint Committee on Government and Finance.
